At time of pleading guilty in a California Superior Court the defendant was in custody and was denied the use of his eyeglasses and could not read the supporting police report thus he accepted the DA’;s offer to plead guilty. Two days after accepting the plea agreement defendant was released on bail, at time of his release the defendant property was returned which included his eyeglasses. The defendant was then able to read the arrest report and the official police report and noticed several discrepancies and realized he shouldn’t have plead guilty. Should the defendant expect the court to grant his motion to withdraw his guilty plea based upon his inability to read the supporting documents arrest report and police report at the time of his plea.

    Didn’t you have a lawyer at this hearing? What advice did he give you?

    I suspect you can use this excuse, lame as it is, to change your plea. However, you may well be shooting yourself in the foot.
